Is it legal for my fiance to sell tanning lotions in front of a store?

My fiance wants to sell tanning lotions at a cheaper rate than the tanning salon she used to work at. Would it be legal for her to hand out business cards in the old salon she used to work at? Would she be able to walk into the store and give them out or would she be able to stand outside of the store?

"Hand out business cards IN the old salon she used to work at"? Huuu? You nuts? Why pray tell would the old salon let her in to do anything?

I see a "Cease and Desist" order being slapped on her real soon. She didn’t by any chance sign a "Covenant not to Compete" agreement when she was hired by the salon did she? (Common in my neck of the woods).


I think she aught to smarten up! If her product is good, and she’s good at selling it, she should find her own space. Customers might be suckered into a cheap thing once, but rarely twice. She’s cutting off her nose to spite her face by being a nuisance and plain OBNOXIOUS. It just looks bad! This is no way to do business, and you know it.

Tell her to move on and maybe she can save her reputation and some steep legal fees.

  2. No on both counts. She needs to stay away from her former employer’s premises.

    And she cannot set up a table or something on the sidewalk without a permit, and most towns do not allow it at all!

  3. No—-it may not be illegal but you would be tresspassing if the owner objects

    Surely unethical—–You would not get other clients by jsut trying to undercut your previous place of work

    It is OK to stand outside, but the loyal customers to your old place would ignore you—-just because it is not cool–and it is unethical

  4. Legal …. Yes and No.
    Your fiance can do that all he wants until he is asked to stop and/or leave. Once he has been asked to stopped handing them out…. or asked to leave he is now trespassing.

    As for standing outside handing out cards. Stay about 10 feet off the front of the store and it is totally legal. It can be construed as solicitation but nothing can be done about it unless an officer asks him to stop and he continues.
